New deadlines and other enforcement measures to prepare for the enforcement of some provisions of the New Civil Procedure Code (in force since 2013) were published on 15 December 2016 in the Official Gazette GEO no. 95/2016. Previous enactments, such as Law no. 2/2013, delayed implementation of some provisions of the New Civil Procedure Code until January 2017. This most recent enactment again includes a delay to January 2018 for these provisions of the New Code.
The act delays implementation of the following until January 2018:
- Provisions governing the exclusion of the public during a trial and during debates between the parties about the merits of the case.
- Provisions governing the procedures necessary to be performed by the appeal and second appeal courts to take a case on appeal or a second (recourse) appeal.
- Provisions defining decisions from which a second (recourse) appeal cannot be filed.
- Provisions establishing the structure of the High Court of Cassation and Justice panel that resolves requests sent to the High Court of Cassation and Justice for review.
